That is not true. According to town laws, no above ground pools are allowed. Check with the town. There may be exceptions, but I don;t know of any. Kris
actually, I checked Kris, with the association.. YES you may have one of those temp blue pools. It is NOT the town that has the rule... it is Luther Forest Home Owners Assocations,. You may nt erect a permanant above ground. One of the temps is ok, they even discussed it at a HOA meeting.
In 1986 the Declaration of Covenants, Conditions, Restrictions and Easements stipulate in Article V, Section 2 Use Restrictions to Lots, #11 reads as follows:
No above-ground pools may be constructed. Inground pools shall be screened with vegetation and shall be enclosed by a fence.
Unfortuately, back in 1986, the Mackeys and attorneys representing Ermine Lair made sure that we could not use above ground pools. We could vote to over-ride, but you need two-thirds of ALL homeowners to vote to take such action.
That translates to 66 percent of the 489 homeowners to vote in a special election. No way are you going to get the 340 or so homeowners to go along with such a proposal. Sorry.
she isnt asking to "construct" an above ground pool, . she just wants a temp , like a sprinkler. Stop being such a stick in the mud...it is a temp pool for 9 weeks. CHECK WITH THE ASSOC.
KBP, I checked with our association's attorney and yes, though the word "construct" may be confusing, it is the legal language necessary to prohibit such pools. I actually am in favor of above ground pools, but unfortunately, not much more support in Ermine Lair as a survey taken three years ago suggested strong opposition. Furthermore, if you want a kiddie pool - one without a filter or electrical components - I am sure no one would object. As far as being a "stick in the mud" - ummmm, well, I never heard that before so therefore I can't respond.
If your property is fenced - I would say go for it. If not, a 12 ft x 3 ft pool in an unfenced area is only inviting trouble. That's deep enough for any toddler to drown in. Too much of a liability.
I think JP makes a good point, and because of the size the town ordinces may come into play. actually, because of the safety issue, I know folks (unfenced yard) who will put them up only when they plan to spend the day "poolside" and they drain them at the end of the day rather than take the risk. That approach may also, in a roundabout way, address the HOA rules.
Don't even mention that, Roy. I'm really heartbroken about the mess we have at the corner of Dunning and Partridge Drum. All those trees that have been cut down - sure takes away for the rural feeling of the area.
Just to get all of the forest critters up to speed here on pools i live in Fox Wander West and last year was told that they were not concerned over my temp. pool. So as i have said in other posts my pools is back up and running again this summer. I have a fenced in yard with a 18'x48" pool. the only shame in all this i think the more permanent type looks far better then the temp pool look but oh well something is better then nothing i guess
